Case #06-040              188 No.End Blvd.-Attorney James Brightney

Will be heard by 4 member board. Refreshed case from opening of 2006. Original request was for a variance to raze two existing structures and replace with one three family dwelling within the side yard setbacks. The board voted to change request to a finding Board at that time requested the applicants to go to the abutters to work out an agreeable setback. Parties have been unable to reach any agreements. Applicants requesting to continue with the original requested setback 3.5’ on south side, 6.5’ on northside, 11.7’front, 2 story, 35’. This will reduce the current non conforming structures, new construction on pilings to conform to current zoning. 6 new parking spaces will eliminate street parking. Not adding any new non-conformities. Front and rear in line with other existing structures, and 3 family in continuing the current use. Value will increase abutters as well as owners properties. Request is not more substantially detrimental and will not adversely affect neighborhood.

Tim; parking-how will they enter parking area as plan shows retaining walls in entrance?

Atty; explained they are to be removed, Tim finds the plan confusing and cannot approve as it is would need to see parking plan. Mark; any way to move proposed back from street.Atty; no because of dune restrictions.

Attorney Welch representing OceanHavenCondoAssoc. Is confused about this most recent request. Stated reconstruction not included in finding description. And what about the second submittal for an amended application for height?Believed the first to be withdraw on 11/14/06. Confused about what is now requested.

Some Board members confused on all the applications and plans and would like clarity on all of these requests. Kendra suggested a complete withdrawal and asked for resubmittal. Tim suggested coming before the board for an informal presentation .

Kendra suggested to apply for a findings for use and a variance for setbacks.

Mr. Brighney requested the withdrawal without prejudice for both applications

Plan changed to reflect an improvement to 7’ side yard setbacks all other requirements to be met
