Minutes March 27, 2007

 

Salisbury Elementary School Meeting open at 7:15 P.M.

 

Members present: Charlie Mabardy,  Tim Lamprey, Kendra Pike-Osgood, Bill Spinney

 

Case #07-003             109 Rabbit Road-Landscape Express

Letter from Attorney for Landscape Express requesting a withdrawal.

Attorney Robert Eberle representing abutters had complaint that there have been numerous continuances and that the work at Landscape Express has not ceased and that abutters were not aware of this meeting until today.

Bill Spinney suggested opening the case so abutters present may be heard. Members not clear on the legality of opening a case without applicant present to speak. Members suggest to look into legality of closing this case.

Motion by Kendra to continue to April 10 for five members to be present to vote on withdrawal

Case 06-057               109 Atlantic Ave.- Jim Babbin, Millennium Eng

Applicant advised no decision can be made for lack of voting members. Charlie read letter from abutter.

Jim Babbin; preexisting non conforming setbacks and lot coverage. Owners wish to add to existing bath  to make for handicap access and extend living area for bedroom for handicap mother.

Abutters present: Mr. Jajuga in favor of recent changes on new plan submitted. Abutters have worked with Mr. Parthum on the improved design. Members; Kendra asked  exterior stairs and having them open without a covering. Bill concerned with the extreme non conformity of the addition as it is creating more density, the house is on the lot line, concerned with accessibility to maintain property  and potential of beach evacuation . Tim feels hardship is being created and the hardship is not with the land. Much too close to abutting property

Motion by Kendra to continue to April 10

Case 07-005               68-70 No.End Blvd.-Ron Laffely, FulcrumArchitects

Accepted four member board. Applicant has Conservation approval, has applied to planning board to combine lots. Existing two units to be razed, to construct new two family. Cupola height of 41’ requested to be used for stair access to roof deck, cupola not to be used as living space. Roof deck barbeque to be hardpiped not propane cylinder. 5’ setback is from upper level.

Abutter Mr. Antista 59 Central concerned with first floor potential of being used as an apartment, Mr. Laffely stated it would be used as guest bedroom and cabana room.

Motion by Tim to grant per amended plan presented this date

Case 07-006               77 Central Ave. – Ron Laffely, Fulcrum Architects

Accepted the four member board.

Request for Cupola at 40’, cupola to be for stairway access to roof deck. Setbacks at rear 5’, Planning Board has agreed to lot line adjustment.

Abutter Mr. Antista 59 Central Ave.no objections to plan.

Motion by Tim to grant amended plan presented this day

2nd by Bill all in favor.

 

Case 06-048               19 Cushing St.-Ciaramitaro

Not present. Board asks for a letter to be sent registered mail requesting the presence of applicant for an update on their status or withdrawal.

Motion by Bill to continue to April 10 with letter to be sent

Case 07-010               4 Main Street-Doug Hanson, Signs by Doug

Request for a freestanding illuminated sign 9’ X 5’  /  45sq.ft.. Would remove other existing illuminated sign if only one permitted. Board would like to visit site.

Motion by Tim to continue to April 24th
