July 6, 2005

RW opened the meeting at 7:20 under the wetlands protection
act and the Town of Salisbury Wetlands
Protection Bylaws.
TH moves to take an item out of order. DH seconds.
Unanimous.
DCR asks for an emergency permission to install snow fence as soon as possible due to the
damage on the beach. Also need permission to bring in sand to make the area
safe. IA motions to approve for discussion. PF seconds. Discussion follows and
a list of items is made for the emergency permission as follows: 1. Install
fences to control pedestrian traffic 2. Install ramps for safety 3. Plant dune
grass where needed. 4. Fill in eroded areas where access to the beach is
needed. 5. Install fences for safety where needed. A vote is taken. Unanimous.
BUILDING PERMITS
Ron Laffely presents a building permit for 22
Lafayette Rd. PF motions to approve roadway and
barn. IA seconds. Unanimous
Ron Laffely presents a building permit for 6 - 9th Street,
stating that a superseding order hasn’t been rescinded. TH motions to send a
letter to DEP to get the status on this project. IA seconds. Unanimous.

PUBLIC HEARINGS
Public hearings were opened at 7:30 p.m.
#1. NOI: George Hughes, 7 McCarthy Way. TH motions to continue to
July 20, 2005 at 7:15 p.m., and requests that the applicant address the issues
presented by Mary Rimmer. DH seconds. Unanimous.
IA motions to take item #4 out of order. TH seconds.

#4. NOI: Northpoointe Builders, LLC, Off Seabrook Rd. DH
motions to continue this to July 20, 2005 at 7:15 p.m. TH seconds. Unanimous.

#6. NOI: Mark Welch, 7 & 9 Bridge Rd. (IFS) IA motions to continue
to July 20, 2005, at 7:15 p.m. TH seconds. Unanimous.
#2. NOI: Chris
Fraser, 114 Bridge Road.
Chris Fraser describes the project and the board reviews the drawings and plans
presented. Matt Persard has reviewed the plan and submitted a letter dated June
15, 2005. IA motions to approve. PF seconds. Unanimous.
#3. NOI: Peter Lee, 9 Atlantic Ave. Eric Botterman describes
the project. Rebecca Haney letter is presented and reviewed. Matt Presard has
reviewed and approved. EB says this project meets the CZM requirements. Some
discussion followed concerning the parking under the building and the plantings
to be done on the 20% of the area that will not be covered. IA motions to
approve the project on the condition that the Conservation Commission receive a
planting schedule. PF seconds. Unanimous
#5. 6 Old Elm Street,
Eric Botterman with Millennium presents the plans. EB states that Joe Sawacki
has reviewed the plans and has sent comments. New revised plans are not ready
so EB will present the details to the board tonight. TH motions to continue
this and ask that a revised set of plans be sent to the Conservation
Commission, and that Joe Serwatka present comments by Friday July 15, 005, so
that the material can be mailed to the board members before the next meeting.

#7. NOI: Betty Murphy, 154 North End Blvd. Jeff Keely and Betty
Murphy appear to present case to board. JK presents photographs for the board
to review. The proposed deck would require 6 posts and all would be dug by
hand. PF motions to approve. IA seconds. Unanimous.
#8. RDA: Anthony Sciuto, 12 Commonwealth Ave. Anthony Scuito presents plans to add a deck and put a drainage ditch in front
of garage to control run-off water. PF motions to issue a negative
determination, (approved). TH seconds. Unanimous.
#9. RDA: MJF Bowery LLC/ Series A, 11 North End Blvd. Ron Laffely presents
the project to the board. He requests that the unpaved area alongside the paved
parking area be approved for pavement also. His argument is that the 1991
handicap laws require pavement for handicap customers. This is commercial
property and considered a public area. Discussion followed on other options,
including a hard surface of clam shells as an alternative, and that a NOI
should be filled for this type of
proposed project. TH motions to find this in the positive determination
(not approved).IA seconds. Vote: 4 in favor, 1 opposed, (PF).
#10. NOI: Frederick Murdock, 8th St. West. An abutter requests that
the house be moved over because the work could damage his foundation which is
old and shallow. Ron Laffely represents the applicant and presents details on
the project. RL offers to have an independent contractor inspect abutter’s
property before and after the pilings are put in. An abutter at 467 North End Blvd.
is concerned that the marsh vegetation will be removed during the work process.
A pump station that services over 600 people is located on property and
flooding in that area could greatly affect the pump station. Another abutter at
483 North End Blvd.
states that this is part of registered land, and Salisbury Beach
has owned it since 1998. RL says nothing will be built on the lot she is
talking about. TH motions to continue to July 20, 2005 at 7:15 p.m., and have
Mary Rimmer review this first.. More discussion followed on the placement of
utilities and plantings. IA seconds. Unanimous.
#11. RDA: Mary T. Hickey, 70 Atlantic Ave. Eric Botterman
says the foundation is crumbling and the proposed plan would replace the 28’ at
the corner. RW suggests that a NOI be filed, and that a positive determination
be found for this property. PF motions to find for a positive determination
(not approved). IA seconds. Unanimous.
#12. RDA: Jean Soucy, 199 Atlantic Ave. The applicant requested
to repair the piling and stairs that
were damaged in the May nor’eastern storm. TH suggests that this is an emergency
situation and he motions that approval be given for an emergency permit or
permission, under the 310CMR10.06 section. The conditions are 1. Equipment
access the beach through the state reservation. 2. No work be done on the
dunes. 3.Shore-up damaged pilings and existing stairs to the beach. 4. No
concrete will be poured. 5. Dig the holes 3’ deep, and put in sand and rocks.
6. Limit the movement of rocks only to shore up pilings and dry laid base for
piling and stairs. IA seconds. Unanimous.
#13. NOI: Knight Oil, Inc. 126-130 Rabbit Road. Patrick Seekamp
presents the plans to enlarge the current pocket wetlands. Mr. Joe Serwatka has
reviews the plan. TH motions to continue to July 20, 2005 at 7:15 p.m. with the
condition that Mr. Serwatka review the drainage with respect to wetlands
protection act, and that Mary Rimmer confirm the boundaries, and that a full
planting schedule be prepared for site. IA seconds. Vote: 4 in favor, 1 opposes
(PF says board should approve the project now).
#14. NOI: Lisa Robinson, 78 Lafayette Rd. Eric Botterman
says this property owner requests to be tied into town sewer, within 50 of
wetlands, and will install a grease trap to existing sewer system where Allan
Drive is located. TH motions to approve. IA seconds. Unanimous.
#15. NOI: Emery
Lake, 21 Lafayette Road. Eric Botterman
presents for the proponent. Plan is to put new construction without a deck on
property. TH says that no deck could go
there since it would be in the 40’ zone. TH motions to approve with the conditions
that no deck be placed on building without prior approval by the board, and
that a silt fence be installed prior to the demo of existing building. PF
seconds. Unanimous.
#16. NOI: Heritage Park Homeowners Coop, 194 Lafayette Rd. Eric
Botterman says a sewer needs replacement
and describes the details. TH motions to approve project on the
condition that the engineering firm identify the source of failure and design a
system to help prevent future failures and be required to put those in place.
PF seconds. Unanimous.
NEW BUSINESS
PF moves to take item #3 out of order. DH seconds.

#3. Ahmad Arash, 147
Bridge Rd., Modification to NOI. Ron Laffely
presents plans to place on the property two catch basins elevated higher than
in original plan. Another change is that asphalt will be used instead of
pavers. PF motions to approve the modified plan. DH seconds. Unanimous.

needs a site inspection. DH volunteers to do the site inspection and requests
that he be given “as built plans”.
