BOARD OF SELECTMEN MINUTES OF JULY 7, 2008

 

PRESENT:     Selectmen Jerry Klima, Chairman; Don Beaulieu, Ed Hunt, Henry Richenburg

ABSENT:        Fred Knowles

ALSO PRESENT:  Neil J. Harrington, Town Manager and Janet Flannery, Secretary

 

I.          Call to Order/Salute to the Flag

Chairman Klima called the meeting to order at 6:00 PM in the Colchester Room, Salisbury Town Hall.

 

II.        New Business

            a.  New License

Motion by Selectman Richenburg, Second by Selectman Hunt; unanimously voted to approve a General license for Bucciarelli’s Meat Market, LLC – 147 Bridge Rd. subject to the health officer’s inspection and providing proof of insurance.

 

            b. Vote to approve Recreational Trail Easements from:

                        386 Elm Street Realty Trust, and

                        True North, LLC

Chairman Klima explained that in connection with the Planning Board’s approval of the subdivision to be built on Rabbit Road, Mr. Vaughan had agreed to make a $100,000 contribution for the water main improvements on Old Elm Street and Rabbit Road and an easement to connect the Salisbury Point Ghost Trail to Rabbit Road.  A vote was adopted at the Town Meeting in October of 2007 authorizing the Selectmen to accept the easement when offered.  In order for it to be recorded and registered in the Registry of Deeds an official vote needs to be taken by the Board.

 

Motion by Selectman Beaulieu, Second by Selectman Richenburg; unanimously voted to approve and accept the recreational trail easement from 386 Elm Street Realty Trust.

 

Motion by Selectman Beaulieu, Second by Selectman Richenburg; unanimously voted to approve and accept the recreational trail easement from True North, LLC.

 

            c.  Special Municipal Employee Appointment

Mr. Harrington explained that Tom Hughes, who has just been appointed to the Board of Health requested that the Selectmen appointment him as a Special Municipal Employee.  Because he owns an environmental consulting firm he realized that while serving as a member of the ConComm he could not represent potential clients before that Board.  Now that he has resigned from ConComm he would like to represent clients before that Board.  In researching the law all members of a board need to be designated as special municipal employees even if just one member requests such designation.  The designation does not mean that Board of Health members are full-time employees of the Town, it only allows them to represent clients before other Boards and if they do they must file a Ch. 268A disclosure statement with the Town Clerk and Ethics Commission.

Motion by Selectmen Richenburg, Second by Selectman Hunt; unanimously voted to approve a special municipal employee appointment for Tom Hughes and the Board of Health.

 

III:      Other Business

Selectman Hunt asked if evaluations were going to be given to Dept. Heads and Mr. Harrington said he is still working on the format but once that is done they will be evaluated.  Selectman Hunt also requested a copy of the organizational chart and the Manager said he would get him one. 

 

Selectman Hunt inquired about the Transportation Improvement Plan and the Manager indicated that the State is just going over the draft TIP.  Right now the Town doesn’t have anything to go on for the next 3 years; until a project is designed it doesn’t get on the funding list.  Selectman Hunt said he thinks that the sidewalks and some of the roads are in bad repair and should be prioritized on the TIP program.  Mr. Harrington said that the DPW Director has a list of the sidewalks needing repair, but the Town doesn’t have the money right now to repair them and there are no grants available for sidewalks.  Selectman Richenburg requested that the DPW Director supply the Board with his list along with the cost for each item.  Selectman Hunt questioned the $2M state grant given for the rail trail in the TIP while people can’t walk on some sidewalks and some of the roads need repair.  Mr. Harrington explained that the money comes from two different funding sources.  The Selectmen discussed possible funding sources for sidewalk repairs and the development of a priority list as had already been done for road repairs.    Selectman Beaulieu clarified for the public, that if Salisbury didn’t get the grant money for the rail trail another town would have and none of it can be used for sidewalks or any local street paving.  The grant money is earmarked for the rail trail and it’s a positive thing and not negative – it’s all Mass. Highway money.

Motion by Selectman Richenburg, Second by Selectman Hunt; unanimously voted to adjourn at 6:55 PM.
